Sony Music Enforces Copyright with Massive Deepfake Takedowns and Discusses AI Principles

Published November 30, 2023

Artificial Intelligence (AI) is profoundly influencing the world of copyright law and music, as evidenced by the discussions at a recent AI Insight Forum hosted by US Senate Majority Leader Chuck Schumer. Dennis Kooker, President of Global Digital Business & US Sales at Sony Music Entertainment, was among the speakers, advocating for the protection of creative copyright in the age of AI.

Highlighting Sony Music's stance on AI and copyright issues, Kooker discussed how the company has had to take considerable action against unauthorized AI-generated content by issuing nearly 10,000 takedown notices to various online platforms.

Unauthorized Deepfakes and Intellectual Property Challenges

One significant concern for Sony Music is the creation of deepfakes and unauthorized voice clones, which exploit artists' rights and can mislead fans. Kooker pointed out that these fakes not only infringe on the artist’s income but also confuse consumers, potentially detracting from the genuine artist’s streaming revenue and royalties. He emphasized the need for legal protection against such activities and praised the No FAKES Act, which seeks to establish federal rights against unauthorized AI-generated replicas.

Optimism for AI's Creative Potential

Despite the challenges, Kooker also acknowledged the promising possibilities that AI technology might offer to the music industry. He revealed that Sony Music is in roughly 200 active discussions with AI startups, some of which involve potential investments, to develop innovative AI tools that could benefit artists and protect their content more effectively.

Sony Music's Principles for AI Engagement

To steer the development of AI in music, Sony Music proposed a set of guidelines for Congress to consider. These principles focus on ensuring consent, compensation, and credit for artists; rejecting the notion that training AI models with copyrighted music should be considered fair use; preventing unauthorized cloning of artists’ voices; encouraging accurate recordkeeping; and promoting transparency for both consumers and artists.

Kooker's insights at the forum illustrate the complex balancing act between embracing the potential of AI in the arts and safeguarding the rights of creators.
