After a contentious noise complaint and an extensive legal struggle, Manchester's renowned music venue and nightclub, Night & Day, has secured its future. The dispute began when a new resident lodged a complaint about the venue's sound levels following their move to Manchester during the lockdown period. In the face of adversity, over 94,000 supporters, including influential artists like Johnny Marr and New Order, rallied behind the venue, signing a petition against the Noise Abatement Notice (NAN) slapped on Night & Day. The venue reportedly incurred around £160,000 in court expenses throughout the ordeal. Manchester Magistrates' court witnessed District Judge Margaret McCormack make a pivotal decision that allowed the venue to continue its operations, suggesting a mixed-use consideration for the evolving Northern Quarter.

The Judge's Ruling

Judge McCormack acknowledged the nuisance caused by Night & Day but also recognized the vibrant nature of the Northern Quarter. She ultimately decided to vary the notice, imposing a set of sound restrictions known as "test profile one". The venue is required to conform to this profile, with modifications to be undertaken by professional acousticians and integrated into their sound system. Night & Day has been given a 28-day window to implement these changes.
